DEQ seeks comment on draft 401 water quality certification for Amish Ranch berm remediation project

The Idaho Department of Environmental Quality (DEQ) seeks comment on a draft 401 water quality certification for the Amish Ranch berm remediation project.

The project proposes to remove approximately 2,000 cubic yards of imported fill material from the ordinary high-water mark of a Boise Riverside channel in Canyon County, Idaho. The project is being conducted in response to a notice of violation issued to the applicant by the U.S. Army Corps of Engineers, for unauthorized fill in Waters of the United States. The proposed project would remove the constructed berm to restore the area to near pre-existing conditions, while also constructing grade control features at the head of the side channel to prevent future downcutting and complete capture of the main channel of the Boise River. The project proposes additional stabilization of the banks by establishing vegetation using native plantings, and riprap structures. The project is designed to maintain historic flow regimes within the side channel, while still addressing concerns of the applicant. The proposed project would reconnect the Boise River with its natural side channel and would result in impacts to 540 linear feet of the river. There are no reported impacts to wetlands resulting from this project.

Based upon review of the federal permit application, readily available water quality related materials, and certification request in accordance with the Clean Water Act § 121.5 (b) and (c) and 121.7 (c), DEQ, certifies that if the permittee complies with the terms and conditions imposed by the permit and the conditions set forth in this water quality certification, then it is reasonable for DEQ to conclude that the activity will comply with water quality requirements, including applicable requirements of the Clean Water Act §§ 301, 302, 303, 306, and 307, Idaho’s “Water Quality Standards” (IDAPA 58.01.02), and other appropriate water quality requirements of state law.

The certification materials are available for public review at DEQ’s State Office (1410 N. Hilton Street, Boise, Idaho) and on DEQ’s Public Comment Opportunities page.
