DEQ seeks comment on a proposed settlement action with HJ Grathol, LLC

Accepting comments from October 6, 2025, through November 6, 2025.

The Idaho Department of Environmental Quality (DEQ) seeks comment on a proposed settlement action with HJ Grathol, LLC, located in Athol, Idaho.

DEQ proposes entering into a Compliance Agreement Schedule with HJ Grathol, LLC to ensure compliance at The Crossings, a private municipal wastewater treatment and reuse facility, as allowed under Idaho Code § 39-116A. The facility was previously authorized under Reuse Permit M-246-01, which expired on August 26, 2025, and is now being replaced by Reuse Permit M-246-02.

The schedule and permit establish enforceable milestones to comply with the “Wastewater Rules” (IDAPA 58.01.16) and the “Recycled Water Rules” (IDAPA 58.01.17). Requirements include developing monitoring and operation plans, updating facility management documents, and completing a lagoon seepage test. Ownership or operational transfer of the facility is restricted until DEQ determines the facility has achieved compliance based on demonstrated performance.

The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 North Hilton Street, Boise, Idaho 83706. Written comments will be accepted until 5 p.m. MST on November 6, 2025. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
