Rulemaking initiated to align with federal national primary drinking water standards.

Status of Rulemaking

Negotiated rulemaking meeting May 13, 2026.  Rule Draft No. 1 comment deadline May 20, 2026.

Overview

The goal of the rulemaking is to update Idaho’s Groundwater Quality Rule to align with the federal national primary drinking water standards, where appropriate, resulting in consistent standards protective of human health. The intent is to address Table II – Primary Constituent Standards, found in Section 200, which will include arsenic, lead, uranium, and certain perfluoroalkyl substances.

Additionally, the rulemaking will consider establishing new groundwater standards and whether existing implementation provisions, including aquifer categorization procedures, should be clarified or streamlined.
