Status of Rulemaking

Pending rule adopted by the Board on November 13, 2025.  Effective on July 1, 2026, unless otherwise specified in the concurrent resolution.   

Overview

This rulemaking addresses public water system stakeholder concerns regarding the 80 psi maximum distribution system pressure limit contained in IDAPA 58.01.08.552.01.b.v. DEQ seeks to remedy this problem by reverting the psi requirement to its previous level of 100 psi.

On July 28, 2025, a memorandum was issued directing DEQ’s implementation of IDAPA 58.01.08.552.01.b.v. due to unintended impacts of this rule on the regulated community since its revision, effective July 1, 2024. The Department is waiving the requirement to keep static pressure in the distribution system below 80 psi in IDAPA 58.01.08.552.01.b.v. Waiver authority is provided to the Department under IDAPA 58.01.08.552.01.b.v.
