DEQ seeks comment on proposed settlement action with Trilogy Development, Inc.

Accepting comments from March 20, 2026, through April 19, 2026.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with Trilogy Development, Inc., located in Boise, Idaho, 83709, for alleged violations of the Clean Water Act and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).

Trilogy Development, Inc. obtained coverage under Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit IDR10C0Z7 (Permit) as an operator at Fossil Creek 2 in Kuna, Idaho. DEQ alleges that on May 15, 2024, Trilogy Development, Inc. failed to comply with all applicable conditions of the permit. DEQ prepared an expedited settlement agreement and consent order directing Trilogy Development, Inc. to resolve the alleged violations and either pay a civil penalty or request a compliance conference. Trilogy Development, Inc. has resolved the alleged violations, made payment in full for the civil penalty of $7,170, and signed the settlement action materials.

The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 North Hilton Street, Boise, Idaho 83706. Written comments will be accepted until 5:00 p.m. MDT on April 19, 2026. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
