Accepting comments from October 23, 2026, through November 23, 2026.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with Apex Land Group, LLC, located in Fruitland, Idaho, regarding its Dagger Falls Subdivision site in Emmett, Idaho.

DEQ alleges that during an inspection conducted on August 5, 2024, Apex Land Group, LLC failed to comply with requirements of the Idaho Pollutant Discharge Elimination System Rules (IDAPA 58.01.25) and Idaho Pollutant Discharge Elimination System (IPDES) Construction General Permit No. IDR10C0PH. The alleged violations involved Storm Water Pollution Prevention Plan requirements, storm water team identification and training, required inspections, storm drain inlet protection, pollution prevention controls, sanitary waste controls, and concrete washout management.

DEQ issued a Notice of Violation on August 3, 2026, directing Apex Land Group, LLC to resolve the alleged violations and either pay the assessed civil penalty or request a compliance conference. Following a compliance conference and review of additional information and Record of Resolution documentation provided by Apex Land Group, LLC, DEQ adjusted the assessed penalty. Under the proposed Consent Order, Apex Land Group, LLC will pay a civil penalty of $7,140.

The proposed settlement action is available for public review under Related Documents below and at the DEQ State Office (1410 N Hilton Street, Boise, ID 83706.) Written comments will be accepted until 5:00 p.m. Mountain Time on November 23, 2026.
