The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with Wintz Company, LLC, located in Moscow, Idaho 83843, for alleged violations of the Clean Water Act and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).
Wintz Company, LLC obtained coverage under Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit IDR10C1H1 (Permit) as an operator at Woodbury Subdivision Addition 1 in Moscow, Idaho. DEQ alleges that on February 24, 2025, Wintz Company, LLC failed to comply with all applicable conditions of the Permit. DEQ prepared an Expedited Settlement Agreement and Consent Order directing Wintz Company, LLC to resolve the alleged violations and either pay a civil penalty or request a compliance conference. Wintz Company, LLC has resolved the alleged violations, made payment in full for the civil penalty of $3,350, and signed the settlement action materials.
The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 North Hilton Street, Boise, Idaho 83706. Written comments will be accepted until 5:00 p.m. MT on August 28, 2026. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
