DEQ seeks comment on a proposed settlement action with the City of New Meadows

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with the City of New Meadows, regarding its municipal wastewater treatment plant in Adams County, Idaho.

DEQ alleges that the City of New Meadows failed to comply with conditions of Idaho Pollutant Discharge Elimination System (IPDES) Permit No. ID0023159, which was issued under “Wastewater Rules” (IDAPA 58.01.16) and “Rules Regulating the Idaho Pollutant Discharge Elimination Program” (IDAPA 58.01.25). Alleged violations include noncompliance with lagoon seepage requirements established in IDAPA 58.01.16.493.03.b, based on seepage test results that exceeded the maximum allowable rate. The city also holds Recycled Water (Reuse) Permit No. M-242-02, which will be evaluated through the facility planning process. The City of New Meadows is currently authorized under its IPDES permit to discharge treated wastewater to the Little Salmon River, which is a water of the United States.

To address the noncompliance, DEQ developed a compliance agreement schedule (CAS) that requires the City of New Meadows to complete corrective actions and implement long-term operational improvements. The CAS requires the city to submit routine progress reports and prepare an updated facility plan study that evaluates system deficiencies, reviews feasible alternatives, and identifies the upgrades needed to achieve and sustain compliance with wastewater treatment and recycled water requirements.

The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 N Hilton Street, Boise, ID 83706. Written comments will be accepted until 5:00 p.m. Mountain Time on July 2, 2026. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
