The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with PEG Development, LLC, located in Provo, Utah, regarding its Atlante Homes at Spring Run site in Caldwell, Idaho.
DEQ’s records indicate that PEG Development, LLC maintained authorization under the Idaho Pollutant Discharge Elimination System 2022 Construction General Permit, No. IDR10C0M8 (Permit), at the time of the inspection. DEQ alleges that during the inspection conducted on March 27, 2024, PEG Development, LLC failed to comply with applicable conditions of the permit, the Clean Water Act, Idaho Water Quality Standards (IDAPA 58.01.02), and the Idaho Pollutant Discharge Elimination Rules (IDAPA 58.01.25).
DEQ prepared an Expedited Settlement Agreement and Consent Order directing PEG Development, LLC to resolve the alleged violations and providing the option to either pay a civil penalty or request a compliance conference. PEG Development, LLC has resolved the alleged violations, signed the settlement action, and paid the civil penalty of $6,240.
The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 N Hilton Street, Boise, ID 83706. Written comments will be accepted until 5:00 p.m. Mountain Time on May 20, 2026. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
