The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with Lincoln Property Company Commercial, LLC, located in Dallas, TX 75225, for alleged violations of the Clean Water Act and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).
Lincoln Property Company Commercial, LLC obtained coverage under Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit IDU100074 (Permit) as an operator at LPC Eastport in Boise, Idaho. DEQ alleges that on January 14, 2025, Lincoln Property Company Commercial, LLC failed to comply with all applicable conditions of the Permit. DEQ prepared an expedited settlement agreement and consent order directing Lincoln Property Company Commercial, LLC to resolve the alleged violations and either pay a civil penalty or request a compliance conference. Lincoln Property Company Commercial, LLC has resolved the alleged violations, made payment in full for the civil penalty of $4,975, and signed the settlement action materials.
The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 North Hilton Street, Boise, Idaho 83706. Written comments will be accepted until 5:00 p.m. MT on August 13, 2026. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
