DEQ seeks comment on a proposed settlement action with HJ Grathol

Accepting comments from November 24, 2025, through December 25, 2025.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with HJ Grathol for violating permit conditions at its private wastewater treatment and reuse facility, The Crossings, in Athol, Idaho.

DEQ alleges that HJ Grathol failed to comply with Recycled Water (Reuse) Permit M-246-01, which was issued under Idaho’s “Wastewater Rules” (IDAPA 58.01.16) and “Recycled Water Rules” (IDAPA 58.01.17). Alleged violations include noncompliance with permit requirements for treatment performance, disinfection, turbidity, nutrient limits, monitoring, reporting, and buffer zones. Reuse Permit No. M-246-01 is being replaced by Reuse Permit No. M-246-02.

To address the noncompliance, DEQ developed a Compliance Agreement Schedule (CAS) that requires HJ Grathol to complete corrective actions and implement long-term operational improvements. The CAS directs HJ Grathol to provide DEQ with updated operational plans, quality assurance procedures, and groundwater monitoring data to achieve and sustain compliance with the conditions of the new permit.

The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at the DEQ State Office, 1410 N Hilton Street, Boise, ID 83706. Written comments will be accepted until 5:00 p.m. MST on December 25, 2025. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
