DEQ seeks comment on a proposed settlement action with G & Sons, LLC

Accepting comments from December 5, 2025, through January 5, 2026.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with G & Sons, LLC for violating permit conditions at its Kendall Residence Site in Hailey, Idaho.

G & Sons, LLC, based in Ketchum, Idaho, obtained coverage under an Idaho Pollutant Discharge Elimination System 2022 Construction General Permit for Discharge Activities, Permit No. IDR10C0ZR, as an operator at its Kendall Residence Site in Hailey. DEQ alleges that during an inspection conducted on June 11, 2024, G & Sons, LLC failed to comply with applicable conditions of the permit, the Clean Water Act, “Water Quality Standards” (IDAPA 58.01.02), and “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).

DEQ prepared an expedited settlement agreement and consent order directing G & Sons, LLC to resolve the violations and either pay a civil penalty or request a compliance conference. G & Sons, LLC has resolved the violations, paid a civil penalty of $5,400, and signed the consent order.

The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at DEQ’s State Office (1410 N. Hilton St., Boise, ID 83706). Written comments will be accepted through January 5, 2026 at 5 p.m. MST. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
