Status of Rulemaking
Proposed rule to be published in the October 7, 2026 Idaho Administrative Bulletin. Comment period: October 7 – October 28, 2026.
Overview
The 2026 Legislature adopted H555 which removes solid waste regulatory responsibility from public health districts and assigns it to DEQ for provisions within the Idaho Solid Waste Facilities Act, Title 39, Chapter 74, Idaho Code. Transferred responsibilities include enforcing solid waste management operations; review and approval of operations, closure, post-closure, and corrective action plans; and the establishment and collection of fees.
This negotiated rulemaking is limited in scope to the assessment and collection of the fees H555 directs DEQ to establish by rule.
