DEQ seeks comment on proposed settlement action with Kenaston Corporation

Accepting comments from November 14, 2025, through December 15, 2025.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with Kenaston Corporation, located in Lewiston, Idaho, for violations of the Clean Water Act and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).

Kenaston Corporation obtained coverage under the Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit for Discharge Activities, No. IDR10C0RW (Permit) as an operator at Northwest Fourslide in Lewiston, Idaho. DEQ alleges that on January 25, 2024, Kenaston Corporation failed to comply with all applicable conditions of the Permit. DEQ prepared an Expedited Settlement Agreement and Consent Order directing Kenaston Corporation to resolve the violations and either pay a civil penalty or request a compliance conference. Kenaston Corporation has resolved the violations, made payment in full for the civil penalty of $1,725, and signed the Consent Order.

The proposed settlement action is available for public review on DEQ’s website and at DEQ’s State Office (1410 North Hilton Street). Written comments will be accepted through December 15, 2025, at 5 p.m. MST. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
