DEQ seeks comment on draft 401 water quality certification for Johnson Lane extension project

The Idaho Department of Environmental Quality (DEQ) is seeking comment on a draft water quality certification for the Johnson Lane extension project.

The project proposes extending Johnson Lane across Parcel RP18N03E298375 in Valley County, Idaho. The new driveway will accommodate Emergency Management Services and plow services. The new driveway will cross a palustrine emergent wetland with no known flow. To maintain natural wetland hydrology, a 15-inch culvert with riprap at the outlets will be installed. Roughly 30 cubic yards of clean, structural gravel will be placed within a 536-foot area using standard earth-moving equipment. Sediment and erosion controls (e.g., silt fences, wattles, a stabilized construction entrance, and mulch) will be installed during project construction to reduce potential environmental impacts. Project fill will be sourced from a local quarry, and excess material will be disposed of in an approved upland site. Approximately 134 linear feet of emergent wetland will be impacted.  

Based upon review of the federal ​permit​ application, readily available water quality related materials, and certification request in accordance with 40 C.F.R. §§ 121.5 (b) and (c) and 121.7 (c), DEQ, certifies that if the permittee complies with the terms and conditions imposed by the federal ​permit​ and the conditions set forth in this water quality certification, then it is reasonable for DEQ to conclude that the activity will comply with water quality requirements, including applicable requirements of the Clean Water Act §§ 301, 302, 303, 306, and 307, Idaho’s “Water Quality Standards” (IDAPA 58.01.02), and other appropriate water quality requirements of state law.
