The Idaho Department of Environmental Quality (DEQ) seeks comment on a proposed settlement action with Trilogy Development, Inc., located in Boise, Idaho, for violations of the Clean Water Act and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25).
Trilogy Development, Inc. obtained coverage under Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit number IDR10C10X as an operator at the Valencia Village site in Caldwell, Idaho. DEQ alleges that on February 7, 2024, Trilogy Development, Inc. failed to comply with all applicable conditions of the permit. DEQ prepared an expedited settlement agreement and consent order directing the company to resolve the violations and either pay a civil penalty or request a compliance conference. Trilogy Development, Inc. has resolved the violations, paid a civil penalty of $1,625, and signed the consent order.
The proposed settlement action is available for public review on DEQ’s Public Comment Opportunities page and at DEQ’s State Office (1410 N. Hilton Street, Boise, Idaho 83706). Written comments will be accepted through August 15, 2025, at 5 p.m. MST. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
