Who Needs An Aquaculture NPDES Permit?

 

An aquaculture facility that meets the following criteria or that the U.S. Environmental Protection Agency (EPA) has determined needs a permit is required to have an NPDES permit prior to beginning to discharge. In Idaho, these permits are issued by the EPA.

An aquaculture facility (as defined at 40 CFR Part 122 Appendix C) that needs an NPDES permit is one which:

  1. Contains, grows, or holds fish in raceways, ponds, and other similar structures;
  2. Discharges pollutants to surface waters of the United States during at least 30 days per year;
  AND  
  3. Meets any of these criteria for production or feeding:
    a. Is a cold water aquaculture facility that has a production of 20,000 pounds or more of cold water fish per year; and
      Feeds 5,000 pounds or more of food in the month of maximum feeding,
      OR
    b. Is a warm water aquaculture facility that has a production of more than 100,000 pounds of warm water fish per year;
  OR  
  4. That EPA has determined to be a significant contributor of pollution to waters of the United States. In making this designation, EPA considers the following factors:
    a. The location and quality of the receiving water,
    b. The capacities of the facility,
    c. The quantity and nature of the pollutants discharged, and
    d. Other relevant factors, such as total maximum daily load (TMDL) determinations for watersheds and Clean Water Act §401 certified stipulations by the state of Idaho.
