 Air Quality Permit Applications Overview

DEQ has developed new air quality permit application tools to make the permit application process more user-friendly and to provide DEQ the information required for a complete permit application. The tools include new application checklists and application forms.

Many of the application forms can be used for all three permit program types – Permits to Construct (PTCs), Tier I Operating Permits (TIs), and Tier II Operating Permits (TIIs).

  • A Permit to Construct is required before installing or altering any equipment that emits or potentially emits an air contaminant, unless exempt under IDAPA 58.01.01.220-223. (Refer to IDAPA 58.01.01.200-228.)
  • A Tier I (Title V) Operating Permit is required for any facility that emits or has the potential to emit 10 tons per year or more of any single hazardous air pollutant, 25 tons per year or more of any combination of hazardous air pollutants, or 100 tons per year or more of any regulated air pollutant. (Refer to IDAPA 58.01.01.008.10 and IDAPA 58.01.01.300-397.)
  • A Tier II Operating Permit is required to limit an existing facility’s potential to emit such that the facility is not a Tier I facility. It is also is required to attain or maintain an ambient air quality standard. (Refer to IDAPA 58.01.01.400-410.)

The first step to submit an air quality permit application is to open the Directions for a Successful Submission. These directions provide application submission information and the list of available forms to use. Select and use only the forms applicable to the permitting action.

Complete form CAM if any emissions unit at your facility is subject to 40 CFR 64 (CAM).

 Compliance Reporting

Demonstrate compliance with permit requirements. Required of all Tier I facilities.

Identify compliance methods, monitoring frequency, deviations and excess emissions, and compliance status during the reporting period. Attach to Annual Compliance Certification Form (AQ-C1).

Report status of permit monitoring requirements. Required of all Tier I facilities.

Describe deviations, cause(s), and corrective/preventative measures. Use only if facility experienced deviations from permit requirements during the reporting period. Attach to Semiannual Report Form (AQ-C4) or Annual Compliance Certification (Form AQ-C1).

 Annual Registration

 Excess Emissions

Excess Emissions Initial Notification (AQ-C9) (Word)
Use this form to provide initial notification to DEQ:
• no later than two hours before startup, shutdown, or scheduled maintenance of equipment that is expected to result or results in excess emissions (IDAPA 58.01.01.133.01).
• no later than 24 hours after the beginning of an upset, breakdown, or safety measure that results in excess emissions (IDAPA 58.01.01.134.02).

Excess Emissions Report (AQ-C10) (Word)
Use this form to provide detailed information to DEQ:
• no later than 15 days after the beginning of an excess emissions event (IDAPA 58.01.01.135.01).

Register facility and provide permit and equipment information. For use specifically by rock crushing facilities seeking a PBR.
